Dear guest,

You have booked a stay at the LifeStyle Resort Zum Kurfürsten. With the reservation of the services of our house, an agency contract is concluded. We guarantee that all services agreed with us will be performed correctly and on time. However, we also ask you to observe our general terms and conditions. They regulate the contractual relationship between guest and host and are recognized by you with your reservation.

General terms and conditions and cancellation policy

The following terms and conditions also contain legal information on your rights under the provisions on distance selling and electronic business transactions.

I. Scope of application

These general terms and conditions (hereinafter referred to as “GTC”) apply to all contractual relationships between Buckermann GmbH & Co. KG as the owner of the LifeStyle Resort Zum Kurfürsten, Amselweg 1, 54470 Bernkastel-Kues (hereinafter referred to as “hotel”) and the guest.

II. Special conditions for room bookings

  1. Conclusion of contract for room bookings

Our offers on the Internet, as part of our online booking system, in brochures or notices are only an invitation to the guest to make non-binding room inquiries to us so that we can check free capacities. If we have free capacity, we reserve the requested room and send a reservation confirmation in text form (e.g. by email, fax, etc.). A binding contract for the room booking is only concluded when you send us back the reservation confirmation (our offer to submit a contract acceptance) with the data requested there (name, address, etc.).
For bookings made up to 7 days before arrival, our offer must be accepted within 48 hours, for bookings made 7 days or more before arrival within 24 hours. Otherwise we are not bound to our offers.

  1. Arrival and Departure 

2.1. Arrival must take place between 15 p.m. and 18 p.m., unless a different arrival time has been agreed between the parties. If there is no other agreement and the guest does not arrive by 18 p.m. on the day of arrival, the hotel is entitled to reassign the room for reasons of its obligation to minimize damage.

2.2. The rooms must be vacated by 12 noon on the day of departure.

  1. Payment for room bookings

Payment is made on site in cash or by EC card (PIN required).

  1. Right to cancel

 With regard to our accommodation contracts, there is no right of withdrawal for consumers.

  1. Resignation of the customer / cancellation
    5.1. With regard to the accommodation contract, we grant our guests a contractual right of withdrawal (hereinafter referred to as cancellation) under the following conditions. The cancellation must be made in text form (e.g. by email). The receipt of the cancellation declaration by us is decisive.

5.2. If the guest cancels or does not arrive, we can demand reimbursement for the arrangements made and for our expenses, provided that we are not responsible for the cancellation or the non-commencement of the trip and there is no case of force majeure. When calculating the compensation, usually saved expenses and usually other uses of our services are to be taken into account.

5.3. In the case of the items listed under 5.2. Regulated cancellation - unless otherwise stipulated in our offers - the following room rates are owed by the guest:

We offer one Flex rate and a Offer Rate

Within the Flex rate you have the option to cancel at short notice up to 24 hours before arrival.

Within the Offer Rate enjoy the lower price and have to pay the travel price in full immediately after booking.
In the event of cancellation, the travel price is non-refundable.
You are welcome to take out a travel cancellation insurance of your choice with this package as well.

Should the state government expect further restrictions or closings, you will enjoy full protection.
In this case, you do not have to cancel your trip. The trip would be canceled due to force majeure.
If you have already paid for your trip at the offer rate, you will receive a voucher for the amount.

5.4. Booked treatments can be canceled free of charge on the day before the treatment by 12:00 p.m. If the cancellation is not made on time, we can also demand compensation for the arrangements and expenses made. Taking into account the expenses usually saved, our expense allowance amounts to 80% of the treatment price.

5.5. In the event of a resignation / cancellation by the guest, both parties are free to provide evidence that higher or lower savings have arisen.

  1. Insurance

We recommend taking out travel cancellation insurance and insurance to cover repatriation costs in the event of an accident or illness.

III. Special conditions for the purchase of vouchers

  1. Conclusion of contract when purchasing vouchers

We offer the opportunity to purchase vouchers or residence vouchers on our website. Vouchers are personal. Voucher offers from us are a binding offer to conclude a contract. If you want to purchase a voucher, you can first configure it without obligation. This is done by selecting the product and specifying your mandatory data as well as selecting the shipping and payment method. Changes or cancellation of the order by closing the browser window are possible at any time. You can check your data and information in the order overview. By clicking the button "Buy now for (...) €“A fee-based contract is concluded. You will immediately receive an order confirmation from us, if necessary the voucher, provided that the dispatch type "E-Mail" has been selected.

  1. Delivery

Depending on the type selected, vouchers are delivered either as a PDF file to be printed out by yourself to your e-mail address or as a letter by post. When sending vouchers by post, the delivery time is approx. 5 working days. We do not charge any delivery costs for sending vouchers.

  1. Payment

Payment is made by invoice, PayPal, instant transfer or credit card. When paying on account, payment must be made no later than 10 days prior to arrival.

  1. Validity of vouchers

Unless otherwise agreed, vouchers are valid for 3 years. With the payment method SofortÜberweisung, PayPal and credit card the voucher can be redeemed immediately, with payment on account with receipt of payment on our account.

  1. Return of vouchers

We contractually give our guests the opportunity to withdraw from the purchase of a voucher, although we charge a processing fee of € 25,00 per voucher. Statutory withdrawal or revocation rights, which of course do not incur a processing fee, remain unaffected. In the case of vouchers sent by post, the return of the voucher is subject to the condition that the original voucher is given to us.

  1. Information requirements for treatments

We offer extensive treatments for our guests. The guest is obliged to inform the treating staff extensively about existing health restrictions, illnesses, allergies, intolerances etc. before the start of the treatment.

  1. limitation of liability

4.1.  We are unrestrictedly liable for damages or reimbursement of wasted expenses

  • in case of intent or gross negligence,
  • for injury to life, limb or health,
  • to the extent of a guarantee we have assumed,
  • for items brought in within the framework of legal liability according to §§ 701, 702 BGB.

4.2. In the event of a slightly negligent breach of an obligation that is essential for achieving the purpose of the contract (cardinal obligation), our liability is limited to the amount of damage that is foreseeable and typical for the type of business in question.

4.3. There is no further liability on our part unless the requirements of Clauses 4.1. or 4.2. are present.

4.4. The above limitation of liability also applies to the personal liability of our employees, representatives and organs.

4.5. In addition, the statutory warranty rights apply.

  1. Prices

Prices are in euros including statutory sales tax and other price components.

  1. Right to cancel

Insofar as we offer consumers goods or additional services that do not constitute accommodation, there is a statutory right of withdrawal, which we would like to inform you about as follows:


Consumers have a fourteen-day right of withdrawal.

Right of withdrawal for goods

You have the right to withdraw from this contract within fourteen days without the need to state any reason.

The revocation period is XNUMX days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

In order to exercise your right of withdrawal, you must contact us (Buckermann GmbH & Co. In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of cancellation (for goods)

If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods. You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing the condition, properties and functioning of the goods.

The right of revocation does not exist in the following contracts:

Contracts for the delivery of sealed goods which are not suitable for return for reasons of health or hygiene if their seal has been removed after delivery.

Contracts for the delivery of newspapers, magazines or magazines with the exception of subscription contracts.

Right of withdrawal for services

You have the right to withdraw from this contract within fourteen days without the need to state any reason.

The withdrawal period is fourteen days from the date of the conclusion of the contract.

Consequences of withdrawal (applies to services)

For this repayment, we will use the same means of payment as you used in the original transaction, unless expressly agreed otherwise with you; In no case will you be charged for this repayment fees.

Do you require that the services to begin during the withdrawal period, so you have to pay us a reasonable amount in the proportion of up to the time at which you inform us of the right of withdrawal with respect to this contract, services rendered compared to the total amount provided for in the contract services equivalent.

The right of withdrawal exists, unless the parties have agreed otherwise, not for the following contracts:

Subject to sentence 2, contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, transport of goods, vehicle rental, delivery of food and beverages and the provision of other services in connection with leisure activities, if the contract for the provision has a specific date or period provides.

7.1. If the guest does not have a general place of jurisdiction or place of residence in Germany or if the usual place of residence is not known at the time the action is brought, the exclusive place of jurisdiction is the registered office of the hotel.

7.2 Should individual provisions of the accommodation contract or these terms and conditions be ineffective, this does not affect the validity of the remaining provisions.
